OFCCP Releases Revisions to Federal Contract Compliance Manual
On December 30, 2019, OFCCP released its revised version of the Federal Contact Compliance Manual (FCCM). According to OFCCP, the FCCM “…provides guidance for OFCCP’s compliance officers (“COs”) in conducting compliance evaluations, complaint investigations and providing federal contractors with compliance assistance.”
These revisions align the FCCM to the directives, policies, and procedures the agency instituted since the last revisions to the FCCM in 2013. The revisions include additional and revised language regarding VEVRAA and Section 503; the addition of sexual orientation, gender identity, and inquiring about pay as protected bases; and updates to review procedures to align with recent directives covering focused reviews and increased transparency.
It is important to note that these changes to the FCCM do not impose any new or additional requirements on federal contractors and subcontractors. The FCCM is a non-binding procedural document for OFCCP COs conducting compliance reviews and investigations.
