EEOC Announces EEO-1 Data Portal Timeframe

On March 29, 2021, the Equal Employment Opportunity Commission (EEOC) announced the timeframe during which the EEO-1 Component 1 data collection portal will be open to employers. According to the announcement, the portal will open on Monday, April 26, 2021 and remain open until Monday, July 19, 2021. EEOC indicated it will begin to notify EEO-1 filers via email immediately. The EEOC is providing 12 weeks rather than the traditional 10 weeks for submitting EEO-1 data because the agency will be collecting data for both 2019 and 2020.

EEOC had originally expected to open the EEO-1 portal in the first quarter of 2021 in order to collect data for 2019 and 2020. However, the agency delayed the opening of the portal until April. This came after EEOC had already delayed the collection of 2019 EEO-1 Component 1 data due to the COVID-19 pandemic.

Employers with 100 or more employees and federal contractors with 50 or more employees must provide EEO-1 Component 1 data. EEO-1 Component 1 data is the traditional data that employers have provided on ethnicity, race, and sex. During 2019, EEOC conducted the EEO-1 Component 2 data collection that focused on compensation information. There is no compensation component in the current EEO-1 data collection.

New Data Collection Portal

Employers should expect the EEO-1 Component 1 data collection portal to look different than it has in previous years. Collection of EEO-1 data is being coordinated by NORC at the University of Chicago. NORC designed the site used to collect EEO-1 Component 2 data in 2019. The new data collection site for Component 1 information indicates that employers will be able to submit data using an online file system or by uploading data files as they have in the past.
